Scope and Contents of the Series

The Court Cases series primarily contains legal records, 1961-1995, 2001-2002. Millard Farmer participated in numerous cases and the series includes detailed documentation of many phases of the legal process, mostly in capital cases and at many levels of the judicial system up to the U. S. Supreme Court. Cases documented by particularly extensive sets of files include the death-penalty cases of Christopher Burger, 1977-1988, and Horace Dix, 1975-1988, and the racial discrimination case of Roger Cotton, 1991-1995. The records include decisions and orders, as well as motions, reports, testimony, jury charges and jury composition challenges. In addition to records related to the proceedings in a case, files include information on witnesses, related cases and precedents, and some reference material. Formats in addition to legal records include forms, reports, clippings, and other printed material, as well as correspondence and notes.

The series includes the cases in which Farmer himself was a party. The most fully documented cases in the series are Farmer v. Sherrod, 1984-1994 (bulk 1992-1993), and the original case Farmer was arguing when he was indicted on a charge of witness tampering, Palmer v. Texas, 1980-1993 (bulk 1992) which together account for about 10 linear feet of material. Documentation in Farmer v. Strickland and Farmer v. Holton concern the contempt of court charge that led to Farmer’s incarceration in Blackshear, Georgia after the George Street trial. Information about Team Defense Project’s involvement in the events in Blackshear is in Series IV. Files regarding another contempt case, Farmer, et al. v. Georgia, arose from Farmer’s representation of Emmitt Stephens in a racial discrimination case. This series also contains files documenting the suit against the Team Defense Project brought by the Southern Poverty Law Center.

At the beginning of the series is a set of files related to motions and expert witnesses that has been removed from their respective set of case files. Included are files related to two cases documented in Series II and III, those of the "Dawson Five" and of Henry Willis. Cases in which Farmer was a party have also been removed from their original order and placed before the client files.
