Scope and Contents note

Typescript form contract (thermofax) and memorandum note: Contract notarized September 29, 1958, between "John Mercer" for Commander Publications, and Matty Malneck, his wife Claire Malneck, and their three (minor) children, for renewal copyrights for 12 songs listed in "Schedule A." Dates are not filled in on any pages except notary statements. Fee schedule on pages 3 through 5. Signed on page 7 by Mercer ("John Mercer d/b/a; Commander Publications), Matty Malneck, and Clarie Malneck for herself and as guardian for each of the three children. Notarized twice on pages 8 and 9. "Schedule A" lists the songs: "Fool That I Am," words by Mercer, music by Malneck and Signorelli (original copyright dates given, 1934); "Pardon My Southern Accent," words and music by Mercer, Malneck (original copyright dates given, 1934); "If I Had a Million Dollars," words and music by Mercer, Malneck (original copyright dates given, 1934); "Just a Fair Weather Friend," words and music by Mercer, Malneck (original copyright dates given, 1934); "My Adventure," no authorship ascribed (copyright 1934); "The Keeper of My Heart," words and music by Mercer, Malneck (copyright 1935); "If You Were Mine," words and music by Mercer, Malneck (original copyright dates given, 1935); "Santa Claus Came in the Spring," words and music by Mercer, "Malneck on unp. Copyright" (original copyright dates given, 1935); "Eeny Meeny Meiny Moe" (also, "Eeny Meeny Miney Mo"), words and music by Mercer, Malneck (original copyright dates given, 1935); "Meet Miss America," words and music by Mercer, Malneck (original copyright dates given, 1935); "I Saw Her at 8 O'Clock," words and music by Mercer, Malneck (original copyright dates given, 1935); "Goody Goody," words and music by Mercer, Malneck (original copyright dates given, 1935, 1936). "Schedule B" is "Assignment" of rights to the songs to "John Mercer, doing business as Commander Publications," signed by Matty Malneck and Claire Malneck, both for herself and as guardian of their three minor children. Note originally attached to contract: From message pad with printed letterhead and personal name, "20th Century Fox Music Publishing; Barbara Brunow." Handwritten note in green ink reads, "Per Marshall - Money was never paid to Matty Malneck & agreement never honored."
